Elon Musk's X Corp and SpaceXAI Drop Apple From Generative AI Antitrust Lawsuit

Elon Musk’s technology enterprises, X Corp and SpaceXAI, have officially dropped their antitrust lawsuit against Apple, concluding a contentious legal challenge against the iPhone manufacturer. The legal action had targeted Apple for allegedly collaborating with OpenAI to create an exclusive ecosystem that locked competing generative artificial intelligence developers out of key consumer markets.

In a court filing submitted on Monday to a United States federal court, the two Musk-led companies formally moved to dismiss all of their legal claims against Apple. The court filing offered no specific rationale for why the claims against the technology giant were being abandoned, nor did it disclose whether the parties had concluded any form of private settlement agreement behind the scenes.

Although Apple has been excused from the action, the broader antitrust battle will persist. X Corp and SpaceXAI confirmed in their submission that they intend to continue pursuing their claims against OpenAI, which remains an active defendant in the ongoing litigation as the plaintiffs challenge its commercial practices in the artificial intelligence sector.

The legal challenge originated in August 2025, when X Corp and SpaceXAI filed their complaint in US federal court in Fort Worth, Texas. The lawsuit asserted that Apple and OpenAI had entered into an unlawful anticompetitive alliance that violated major regulatory frameworks, specifically citing breaches of both the federal Sherman Antitrust Act and state-level Texas antitrust statutes.

At the heart of the complaint was the exclusive integration of OpenAI’s flagship ChatGPT software into Apple’s proprietary iPhone operating system. The plaintiffs maintained that by establishing ChatGPT as the sole generative AI chatbot natively embedded in the mobile operating system, Apple effectively denied rival developers a fair opportunity to reach consumers through standard mobile device interfaces.

SpaceXAI, which created and operates the competing Grok artificial intelligence chatbot, joined X in arguing that Apple’s exclusive partnership provided OpenAI with an unfair structural advantage. Under the arrangement, ChatGPT gained direct, privileged access to billions of potential user queries and interactions across crucial iPhone functions, including the Siri voice assistant, Apple's built-in Writing Tools, and camera systems.

The plaintiffs argued that being shut out of this extensive mobile ecosystem deprived competing AI enterprises of vital user engagement. Because artificial intelligence models rely heavily on broad user interaction to refine their systems, the plaintiffs alleged that Apple’s exclusive deal severely hindered the ability of outside competitors to achieve necessary commercial scale.

Beyond the deep operating system integrations, the legal complaint took aim at Apple’s administration of its App Store marketplace. The lawsuit alleged that Apple actively disadvantaged competing artificial intelligence services by manipulating search rankings and enforcing discriminatory delays during the application review and approval process for rival chatbot programs.

According to the complaint, Apple and OpenAI leveraged their respective positions across the smartphone hardware and generative AI software markets in tandem. The plaintiffs argued that this collaborative approach served to fortify both companies' commercial dominance while simultaneously erecting major barriers to entry for emerging competitors in the broader tech landscape.

The case had already navigated significant procedural hurdles before Apple's dismissal. Last year, both Apple and OpenAI submitted independent motions seeking to have the lawsuit thrown out of court. Those efforts failed in November when US District Judge Mark Pittman rejected both dismissal motions, allowing the antitrust claims to move forward into active litigation.

In defending its position, OpenAI previously filed court documents accusing Elon Musk of conducting a calculated "campaign of lawfare." The company contended that Musk’s legal actions were part of an ongoing strategy to disrupt OpenAI's market position through the judicial system rather than through standard commercial and technological competition.

The antitrust action in Fort Worth is part of a wider history of legal disputes between Musk and OpenAI. Musk had earlier brought a separate lawsuit against OpenAI alleging that the organization had strayed from its founding charter, which pledged to develop artificial intelligence safely for the public benefit of humanity rather than generating commercial profit. OpenAI successfully defeated that earlier lawsuit in May.

The market prominence of ChatGPT has remained a central factor throughout these legal clashes. Following its initial public rollout in late 2022, OpenAI’s conversational assistant rapidly transformed the tech landscape by becoming the fastest-growing consumer application in history, establishing a massive early lead in the generative AI race.

While the dismissal of Apple brings an end to the direct legal confrontation between the iPhone maker and Musk's AI and social media platforms, the litigation will now proceed solely against OpenAI in Texas federal court, focusing attention on the competitive dynamics governing the fast-evolving artificial intelligence industry.
